1. General

  • This website is operated by Maria Fung. Throughout these Terms, “I,” “me” and “my” refer to Maria Fung, and “you” refers to the visitor, prospective client, or client using this site or engaging my services.
  • By visiting this site, submitting an enquiry, or engaging me for a project, you agree to be bound by these Terms of Service (“Terms”), along with the Privacy Policy, which is incorporated by reference.
  • Please read these Terms carefully. If you do not agree with them, please don’t use this site or engage my services.
  • I reserve the right to update these Terms at any time by posting changes to this page. The “last updated” date above reflects the most recent revision. Continued use of the site after changes are posted constitutes acceptance of those changes. For active client engagements, any material change to these Terms will be communicated directly and will not retroactively alter the terms of a project already agreed in writing.
  • This website is built on WordPress. It functions as a portfolio, informational site, and point of contact — it is not an online store, and no products are sold or fulfilled directly through it.
  • I reserve the right to decline a project enquiry or engagement for any reason, consistent with the “Work I Avoid” section of the FAQs.

2. Scope of Services

  • I offer creative consulting, art direction, design strategy, and related graphic design and writing services. The specific scope, deliverables, timeline, and fees for any engagement are agreed separately with each client — typically via a written proposal, quote, or agreement — before work begins. These Terms govern the general use of this website and apply to all client engagements alongside whatever is agreed in that project-specific document. Where there’s a conflict between these Terms and a signed project agreement, the signed agreement takes precedence.
  • Any timelines, pricing, or availability referenced on this site are indicative only and are not binding until confirmed in writing for a specific project.

3. Intellectual Property — This Website

  • The content of this website — including its design, layout, written content, and portfolio imagery — is owned by or licensed to Maria Fung. Reproduction of this content without express written permission is prohibited.
  • References to third-party trademarks or copyrighted material on this site (for example, client brand names shown in portfolio work) remain the property of their respective owners, and their appearance does not imply endorsement in either direction.
  • Portfolio images are representative of completed work. Actual colours may vary slightly from what’s displayed on screen — see the FAQs for why.

4. Intellectual Property — Client Work

  • Ownership and usage rights for work produced during a client engagement (including copyright, exclusive-use rights, and any agreed transfer of rights) are governed by the specific project agreement with that client, consistent with the general approach outlined in the FAQs. Nothing in these general Terms overrides what’s agreed in that project-specific document.
  • Working/source files are not included in project deliverables by default, as described in the FAQs, unless otherwise agreed in writing.

5. Client Submissions and Feedback

  • If you send me project briefs, reference material, feedback, or other content in the course of an engagement or enquiry, you confirm that you have the right to share that material and that doing so doesn’t infringe on any third party’s rights.
  • Unsolicited ideas, suggestions, or feedback sent to me outside of a paid engagement (for example, general feedback on this website) may be used or referenced without obligation to compensate or credit the sender, unless otherwise agreed.
  • I may decline to use, or may remove, any submitted content I determine, in my judgment, to be unlawful, infringing, or otherwise inappropriate.

6. Accuracy of Site Information

  • I aim to keep this site accurate and current, but information here — including portfolio descriptions, availability, and general pricing guidance — is provided for general reference and shouldn’t be relied on as a substitute for a confirmed, written proposal for your specific project.
  • This site may occasionally contain outdated material (for example, older portfolio entries). I’m not obligated to update every page immediately when circumstances change.

7. Fees and Payment

  • Fees for any engagement are set out in the relevant project proposal or agreement, not on this website, and are subject to change for future or unconfirmed projects without notice.
  • Accepted payment methods for international clients are outlined in the FAQs. Specific payment terms (deposits, milestones, due dates) are set per engagement.
  • I reserve the right to pause or decline further work on a project where payment terms agreed in the project proposal are not met.

8. Third-Party Links

  • This site may link to third-party websites (for example, client sites shown in the portfolio, or press coverage). I’m not responsible for the content, accuracy, or practices of third-party sites, and linking to them doesn’t imply endorsement of everything on them.
  • Any concerns about a third-party site should be directed to that site’s operator, not to me.

9. Acceptable Use

You agree not to use this site to:

  • Attempt unauthorized access to the site or its underlying systems
  • Transmit viruses, malware, or other harmful code
  • Scrape, crawl, or copy site content beyond normal browsing
  • Harass, defame, or transmit unlawful content through any contact form or correspondence
  • Impersonate another person or misrepresent your affiliation with any entity

Violation of these terms may result in restricted access to the site, at my discretion.

10. Limitation of Liability

  • This website and its content are provided “as is,” without warranties of any kind, express or implied, to the fullest extent permitted by law.
  • I don’t guarantee that the site will be uninterrupted, error-free, or secure at all times.
  • To the extent permitted by law, I’m not liable for any indirect, incidental, or consequential damages arising from your use of this website. This limitation does not apply to obligations set out in a specific, signed client project agreement, which are governed by the terms of that agreement.

11. Indemnification

You agree to indemnify and hold harmless Maria Fung from any third-party claim arising from your breach of these Terms or your misuse of this website, to the extent permitted by law.

12. Severability

If any clause of these Terms is found to be unenforceable, the remaining clauses will continue in full effect, and the unenforceable clause will be limited or removed to the minimum extent necessary.

13. Entire Agreement

These Terms, together with the Privacy Policy and any signed project-specific agreement, constitute the entire understanding between you and me regarding use of this website and, where applicable, engagement of my services — superseding prior discussions or communications on the same subject, except where a signed project agreement expressly states otherwise.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Singapore.
